AI Terms of Use

These AI Terms of Use (“AI Terms”) apply when an organization or user accesses AI-powered functionality within ImmerseMe, including AI conversation and related automated feedback features. They supplement the Terms of Use, Privacy Policy and any applicable institutional agreement or Data Processing Addendum.

1. Optional AI Functionality

AI features are optional product capabilities and may be enabled or disabled for an organization. Institutions remain responsible for deciding whether AI functionality is appropriate for their users and for meeting any applicable notice, consent, policy or approval requirements.

2. Educational Purpose

ImmerseMe's AI features are designed to support language practice, feedback and educational engagement. They are not intended to provide medical, legal, financial, psychological, emergency or other professional advice, and they must not be used to make high-stakes decisions about a person.

3. How AI Processing Works

When AI conversation is used, learner speech may be transported through LiveKit Cloud and processed by Microsoft Azure Speech. Conversation text/context may be sent to OpenAI for response generation. Azure AI Content Safety is used for safety moderation. Conversation text, generated responses, moderation metadata and session reports may be stored by ImmerseMe according to its retention practices.

ImmerseMe does not intentionally persist raw learner microphone audio as a stored audio file/entity.

4. Third-Party AI Providers

ImmerseMe uses commercial third-party AI and speech services rather than training its own foundation model.

Current material AI/speech providers include OpenAI, Microsoft Azure Speech, Azure AI Content Safety and LiveKit Cloud. Provider details, processing locations and transfer safeguards are described in the Privacy Policy and Subprocessor Register/Trust Center.

OpenAI model-improvement/data-sharing is disabled for the production API organization. Standard vendor-side abuse-monitoring retention may still apply where zero-data-retention controls are not enabled.

5. No Guarantee of Accuracy

AI-generated output may be inaccurate, incomplete, unexpected, biased, offensive or otherwise unsuitable. Users and institutions should apply appropriate judgment and supervision.

ImmerseMe does not guarantee that AI responses are factually correct or that they will meet a particular educational outcome.

6. User Responsibilities

Users must:

  • use AI features only for lawful and authorized educational purposes;
  • avoid submitting unnecessary personal, confidential or sensitive information;
  • not attempt to exploit, manipulate or bypass safety controls;
  • not use AI features to harass, threaten, exploit or endanger another person;
  • not submit content they do not have the right to use; and
  • comply with the Acceptable Use Policy and any school/institution rules.

7. Student Safety and Human Oversight

AI functionality includes moderation and safety controls designed to reduce inappropriate content and identify severe events. Certain severe events may be stopped and/or flagged for teacher review where implemented.

These controls do not guarantee that all harmful or inappropriate content will be prevented. Institutions, teachers and users remain responsible for appropriate human oversight.

8. Personal Information in AI Conversations

Free-form AI conversations can contain information entered by users. Users should not enter unnecessary personal information, secrets, passwords, financial information, health information or other sensitive data.

ImmerseMe applies data-minimization and safety controls, but does not represent automated PII stripping/detection as an implemented control unless separately verified and documented.

9. Model Training and Data Use

ImmerseMe does not use institutional/customer data to train an ImmerseMe-owned foundation model.

Where third-party providers process inputs/outputs, their use of data is governed by the applicable commercial terms, DPA and configuration. ImmerseMe configures production AI services to restrict provider model-improvement use where supported and verified.

10. Automated Feedback

The service may automatically generate pronunciation scores, learning feedback, moderation classifications, conversation responses and related educational metrics.

Such automated outputs are intended to support learning rather than make legally significant or similarly high-impact decisions. Where a material decision about a learner is required, institutions should use appropriate human judgment and their own policies.

11. Content Ownership and Rights

Ownership of user- or institution-provided content remains governed by the Terms of Use and applicable customer agreement. AI-generated output may not be unique and similar content may be generated for other users.

Users are responsible for determining whether and how AI-generated output may be used, including compliance with copyright, academic-integrity and institutional policies.

12. Prohibited AI Use

You must not use ImmerseMe AI features to:

  • facilitate unlawful activity;
  • generate or distribute content that exploits or sexually abuses minors;
  • encourage self-harm, violence or credible threats;
  • impersonate others deceptively or commit fraud;
  • create malware or malicious instructions;
  • bypass platform security or moderation controls;
  • make prohibited discriminatory or high-impact decisions; or
  • violate the Acceptable Use Policy or applicable law.

13. Suspension of AI Features

ImmerseMe may restrict, disable or suspend AI functionality where reasonably necessary to protect users, respond to an incident, address provider or safety issues, comply with law or prevent misuse.

14. Changes to AI Providers or Models

AI models and providers may change over time. Material changes are subject to ImmerseMe's AI Governance, vendor-risk, privacy-impact, Secure SDLC and Change Management processes.

We will update public documentation where a change materially affects privacy, subprocessors or user commitments.

15. Privacy and Retention

AI processing is subject to the Privacy Policy and DPA. Conversation records retained by ImmerseMe follow the applicable retention schedule. Raw learner audio is not intentionally persisted by ImmerseMe as a stored audio file/entity.

16. Feedback and Reporting

Users and institutions should report unsafe, inappropriate or unexpected AI behavior to hello@immerseme.com so that it can be reviewed.

17. Changes to These AI Terms

We may update these AI Terms as AI functionality, providers, legal requirements or safety practices evolve. The “Last updated” date will be revised when changes are made, and additional notice will be provided where required.
